By entering this competition, you hereby agree to the following terms and represent and warrant to Vino’s Picasso (“Vino’s Picasso” or “us”) that all registration information you submit is truthful, accurate and:
- Eligibility – The competition is open to all artists 18 years of age or older whose use of Vino’sPicasso.com does not and will not violate any applicable law or regulation, or any agreement to which they are a party. Employees of Vino’s Picasso and sponsors are not eligible to enter.
- Copyrights – All of the images that you will be submitting are images of original artwork created by yourself or are artworks created by an artist who authorized you to submit the images on his/her behalf. Images submitted by you do not violate the privacy rights, publicity rights, copyright or other intellectual property rights of any person or entity. You may not post, distribute, or reproduce in any way any copyrighted material, trademarks, or other proprietary information without obtaining the prior written consent of the owner of such proprietary rights. Without limiting our rights, it is our policy to terminate all relations with any artist who infringes copyright upon our receipt of a notice of infringement from the copyright owner or the copyright owner’s legal counsel.
- Your claims in the aggregate shall be the greater of either (a) the insurance proceeds received by either you or Vino’s Picasso in connection with your claim or (b) in the event that your insurance claim is denied for any reason whatsoever and/or is not covered by the insurance policy, no more than the total amount actually paid by you to us in connection with your entry.
In the event that you commence a lawsuit or other legal proceeding against Vino’s Picasso or any of Vino’s Picasso owners, officers, employees, agent, representatives or affiliates in connection with and/or arising from any claim whatsoever relating to the competition and/or our relationship with you in any manner whatsoever; a) you hereby unconditionally consent to the exclusive jurisdiction of the state and federal courts located in the State of Florida, Lee and Collier County, b) Florida law shall apply for the adjudication of any such claim and c) Agora shall be entitled to recover from you all of its costs and expenses relating to any such proceeding including, without limitation, its attorneys’ fees.
Indemnity – You agree to indemnify and hold Vino’s Picasso, its owners, subsidiaries, affiliates, officers, agents, representatives and employees harmless from any loss, liability, claim, or demand, including reasonable attorneys’ fees, relating to any claim made by any third party due to or arising out of your violation of any of the foregoing terms and conditions and/or any breach of your covenants, representations and warranties set forth above.
Private Party terms and conditions.
There is a 12 painter minimum IN WEEKEND. 10 people minimum during the week. You have to pay a deposit of 2 seats. Personal checks are not accepted.Your deposit is non-refundable. You have until 1 week prior to your event to cancel in order to receive a credit of 50% of the total. However, if guests have already registered for your event we will deduct $5 per seat from the credit balance to pay fees imposed on our small business during the processing and refunding of transactions.
No confetti or glitter allowed in the studio.
Space can be limited so we ask that you find alternative plans for babies, toddlers and non-painters. Parents are encouraged to drop off their little ones or remain outside of the painting area during instruction. With years of experience teaching children we know that they flourish best in their own element! As the host/hostess we ask that you help us to enforce this. ** Please encourage parents to drop off their children 15 minutes prior to painting and pick them up 15-20 minutes prior to your exit time.You and your party must be exiting the studio no later than 15 min after your time is finished or a $50 fee for the first 15 minutes before and/or after your event’s scheduled time will be imposed and then $15 for every additional 15 minutes.
Kiddo parties are for ages 6+. Adults can join in on the fun, too!
No credits or refunds for no-shows.
1-2 adults must be present at all times.
The painting should be chosen and sent back with this Private Party Contract. The painting you select cannot be changed once it has been confirmed. NOTE: Please do not promote your event until your painting has been confirmed by a Vino’s Picasso artist. Vino’s Picasso does not cater, have refrigerator space or ice available, but we will have tables for your food and gifts! Coolers are always welcome in a private pARTy setting.
We do not offer credits or refunds for no-shows. BYOB is not permitted during kiddo parties. However, our wine bar will be open.
If you make registration, you agreed with our terms and conditions.
The regular class will be opened if we get 8 people minimum, otherwise, we will offer you to transfer the class to another day, or refunds.
